Intellectual Property & Infringement Policy

Guidelines protecting NewJack trademarks, original graphic designs, slogans, creative assets, and procedures for reporting IP infringement.

Effective Date: 18 July 2026

1. NewJack Intellectual Property

The NewJack brand and its creative assets represent significant investment, craftsmanship, and brand identity. Our intellectual property includes, but is not limited to:

  • The NewJack brand name and wordmarks;
  • Logos, insignias, and brand emblems;
  • Official brand slogans, including "Stay True. Stay You. Stay New.";
  • Product names, collection titles, and campaign concepts;
  • Original clothing graphics, embroidery artwork, and custom puff prints;
  • Textile prints and garment silhouettes;
  • Campaign photographs, lookbooks, and editorial video content;
  • Website design, user interface layouts, and written copy;
  • Packaging, swing tags, and promotional materials; and
  • Software code and digital storefront designs.

These assets are protected by South African copyright, trade-mark, design, common law passing-off, and international intellectual property laws.

Trade marks registered with the Companies and Intellectual Property Commission (CIPC) remain protected indefinitely when renewed every ten years. South African copyright protects qualifying original works for legally defined statutory periods.

2. Permitted Use

You may:

  • View and browse NewJack content for personal, non-commercial purposes;
  • Share official NewJack social media posts using embedded platform sharing tools;
  • Link to the official NewJack website (www.newjack.co.za); and
  • Photograph legally purchased authentic NewJack products for personal social media use.

3. Prohibited Use

Without explicit prior written permission from NewJack, you may not:

  • Copy, reproduce, or imitate NewJack graphic designs or embroidery prints;
  • Manufacture, distribute, or market products bearing NewJack branding;
  • Sell, trade, or advertise counterfeit NewJack products;
  • Use confusingly similar brand names, logos, or slogans;
  • Remove or alter copyright, trade-mark, or brand notices on garments or media;
  • Reuse campaign photographs, lookbooks, or editorial videos for commercial purposes;
  • Modify, digitize, and resell NewJack creative assets;
  • Register domain names or social media handles impersonating NewJack;
  • Suggest an endorsement, partnership, or sponsorship that does not exist; or
  • Use NewJack content to train, market, or operate another commercial brand without authorization.

4. Reporting Infringement of NewJack Rights

If you identify unauthorized copying, counterfeit sales, or trade-mark misuse of NewJack assets, please report it to us:

Please include the following details in your report:

  • Your full name and contact information;
  • A description of the suspected infringement or counterfeit product;
  • The relevant website, marketplace, social account, or physical location;
  • Direct links or high-resolution screenshots; and
  • Any available details identifying the unauthorized seller or responsible party.

NewJack investigates all valid reports and may issue cease-and-desist demands, report listings to platforms for removal, or initiate legal proceedings.

5. Claims That NewJack Has Infringed Third-Party Rights

NewJack respects third-party intellectual property rights. If a rights holder believes that material on our website infringes their rights, they may submit a formal complaint containing:

  • Full name, company name, and contact details;
  • Identification of the protected work or right claimed to be infringed;
  • Proof of ownership or legal authorization to act on behalf of the owner;
  • Exact location or URL of the allegedly infringing NewJack material;
  • A clear statement explaining why the use is unauthorized; and
  • A good-faith declaration that the information supplied is accurate.

6. Review & Investigation Process

Upon receiving a detailed complaint, NewJack will:

  • Acknowledge receipt of the complaint;
  • Temporarily restrict or review the disputed material if appropriate;
  • Review original licenses, design assets, or contributor releases; and
  • Notify the complainant of our determination and any corrective actions taken.

7. Counter-Notice Procedure

If material was removed in error, the affected contributor may submit a detailed counter-notice demonstrating authorization or lawful right to use the material.

8. Repeat Infringement Policy

NewJack reserves the right to terminate relationships, supplier contracts, or customer accounts associated with repeated or intentional intellectual property infringement.

9. Counterfeit Products Warning

NewJack does not guarantee the authenticity, quality, or safety of products purchased from unauthorized third-party sellers, unauthorized social channels, or counterfeit street vendors.

Authentic NewJack pieces are sold exclusively through:

  • Our official website: www.newjack.co.za;
  • Official NewJack pop-up stores & brand activations; and
  • Authorized stockists expressly announced on our official channels.

10. Collaborators, Photographers & Designers

Unless otherwise agreed in writing, creative contributors and contractors must not assume that payment automatically transfers all IP rights. NewJack executes formal written agreements governing IP assignment, licensing, territory, and credits for all commercial collaborations.

11. No Admission

Investigating, restricting, or removing disputed content does not constitute an admission of liability or infringement by NewJack.

12. Policy Changes

NewJack may amend this Intellectual Property Policy as our creative offerings, product catalog, or statutory legal obligations evolve.
